These Terms of Use ("Terms") govern your access to and use of the Biostar CMA platform ("Platform"), operated by Biostar Technology International ("Biostar," "we," "us," or "our"), owned by Ulysses Angulo, and available at biostarcma.com.
By creating an account, accessing, or using the Platform, you agree to be bound by these Terms, our Privacy Policy, and our Medical Disclaimer. If you do not agree, you must not use the Platform.
These Terms constitute a legally binding agreement between you and Biostar Technology International.

Practitioners access the Platform through Aether-Connect, our practitioner authentication portal. To register as a Practitioner, you must:
Patients and clients ("Patients") may access the Platform through a dedicated login to:
Patients must be at least 16 years of age. For patients under 16, the Practitioner must obtain appropriate parental or guardian consent.
Guest users may access limited Platform features without creating an account. Guest access is temporary, and session data is retained for a maximum of 30 days.

You are responsible for all activity that occurs under your account, whether or not you authorised it. Biostar is not liable for any loss resulting from unauthorised use of your account where you have failed to maintain adequate security of your credentials.
Access to Biostar CMA is provided on a subscription basis. Current plans, features, and pricing are displayed on the Platform and may be updated from time to time with reasonable notice.
We may offer free trial periods at our discretion. Unless you cancel before the trial ends, your subscription will automatically convert to a paid plan at the applicable rate.
We may adjust pricing with at least 30 days' advance notice. Price changes take effect at the start of your next billing cycle.
To ensure quality assurance, platform security, data recovery, and technical support, we automatically collect and store:

The Platform, including its software, design, branding, user interface, documentation, and underlying technology, is owned by Biostar Technology International or its licensors and is protected by copyright, trademark, and other intellectual property laws. All rights not expressly granted herein are reserved.
You retain ownership of your User Content. You grant Biostar a limited, non-exclusive licence to process your User Content solely for the purpose of providing the Platform services (including AI processing). This licence terminates when your User Content is deleted from the Platform.
Practitioners retain the right to use, distribute, and incorporate Generated Reports into their professional practice. Biostar does not claim ownership of Generated Reports. Generated Reports may not be attributed to Biostar as their author.
Any suggestions, ideas, or feedback you provide about the Platform may be used by Biostar without obligation or compensation to you.
The Platform uses the Anthropic Claude API for AI-assisted analysis. Payments are handled by third-party payment processors. Biostar does not store your full payment card details. The Platform may contain links to third-party websites; we are not responsible for their content or privacy practices.
We endeavour to maintain Platform availability but do not guarantee uninterrupted or error-free operation.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW: THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
WE MAKE NO WARRANTIES REGARDING THE CLINICAL ACCURACY, COMPLETENESS, OR SUITABILITY OF AI-GENERATED OUTPUTS FOR ANY PARTICULAR MEDICAL OR HEALTH PURPOSE. All outputs are assistive and require independent professional evaluation.
Biostar's total aggregate liability shall not exceed the greater of: the total fees you paid in the 12 months preceding the claim, or €100.
Biostar shall not be liable for any indirect, incidental, special, consequential, or punitive damages, loss of profits, revenue, data, or business opportunities, or damages arising from clinical decisions made using Platform outputs.
Nothing in these Terms excludes liability for death or personal injury caused by negligence, fraud, or any liability that cannot be excluded under applicable EU or national law. Consumer statutory rights are unaffected.
Practitioners agree to indemnify Biostar from claims arising from clinical decisions, failure to obtain patient consent, breach of professional obligations, or misuse of the Platform. All users agree to indemnify Biostar against claims arising from violation of these Terms or applicable law.
You may terminate your account at any time via account settings or by contacting legal@biostartechnology.com.
We may suspend or terminate your account immediately for material breaches. For non-material breaches, we will provide 14 days' written notice and an opportunity to cure.
Upon termination, you may request data export for 30 days. After that, data will be deleted per our Privacy Policy. Surviving provisions include IP rights, disclaimers, limitation of liability, indemnification, and dispute resolution.
These Terms are governed by EU law and the national law of Ireland.
Before formal proceedings, parties agree to attempt informal resolution via legal@biostartechnology.com. We will endeavour to resolve complaints within 30 days.
Disputes shall be submitted to the courts of Dublin, Ireland, except where EU consumer protection law grants you the right to use your local courts.
EU consumers may use the European Commission's ODR platform at https://ec.europa.eu/odr.
These Terms, together with the Privacy Policy and Medical Disclaimer, constitute the entire agreement. If any provision is unenforceable, the remainder continues in effect. Failure to enforce a right is not a waiver. You may not assign rights without our consent. Biostar is not liable for force majeure events. Notices to you will be sent to your account email; notices to Biostar should be sent to legal@biostartechnology.com.
We may modify these Terms with at least 30 days' advance notice. Continued use after changes constitutes acceptance. If you disagree, you may terminate your account.
